Privacy Policy

talech share your concerns about privacy. This privacy policy (“Privacy Policy”) governs your use of our website, applications and related merchant products and services (collectively, the “Services”) and explains what personal information we receive, how we use and share it, our security measures, and includes other important privacy information about storage, access, deletion and the choices you have.

Capitalized words that are not defined in this Privacy Policy will have the meaning defined in the talech Terms of Service.

Please review this Privacy Policy carefully. By using our Services, you acknowledge that you have read and understand this Privacy Policy and consent to the collection, use and disclosure of your personal and non-personal information in accordance with this Privacy Policy. By consenting to our collection, use and disclosure of your personal information as outlined in this Privacy Policy, you will be able to sign up, access and/or use our Services. You can withdraw your consent at any time. However, if you choose to do so, we may not be able to provide you with the Services that we offer.

Information we collect

We collect personal information when you provide it to us and when we receive it through your use of our Services. Personal information is any information that identifies an individual, or by which an individual’s identity could be deduced. This includes:

  • Information you provide. If you sign up for a talech account or participate in a promotion or incentive program, or request information from us, we may ask for personal information, like your name, email address, telephone number, and certain financial information.
  • Information about end-user customers. If you as a Merchant sign up for a talech account, we may collect personal information about your end-user customers in order to process payments or otherwise provide the Services requested by you. This includes personal information such as your end-user customer’s name, email address, telephone number and certain financial information (“Customer Data”). It is your responsibility as a Merchant to ensure that you have all necessary consents in place to collect, use and transfer this Customer Data to us for use in accordance with this Privacy Policy.   • Information we get from your use of our Services. We may collect personal information about the Services that you use and how you use them, like when you visit our website and interact with our ads and content. This information includes:
    • Device information. We may collect device-specific information (such as your hardware model, operating system version, unique device identifier, and mobile network information). talech may associate your device identifiers or phone number with other personal information associated with your talech account.
    • Log information. When you use our Services or view content provided by talech, your device and browser automatically transmit certain information to us that we store in server logs. This information may include your IP address, device event information such as crashes, system activity, hardware and software settings, browser type, browser language, the date and time of your request and referral URL, cookies that may uniquely identify your browser or your talech account, and other details of how you used our Service.
    • Location information. When you use a location-enabled talech Service, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers. You can manage location preferences on your device.
    • Local storage. We may collect and store personal information locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.
    • Cookies and anonymous identifiers. talech uses cookies and similar technologies. Please see our section on cookies below.

How we use personal information

talech uses personal information for the following purposes:

  • To provide, maintain, and improve the Services and to develop new ones;
  • To provide customized content and recommendations;
  • To conduct research on how users engage with our Services;
  • To protect talech and our users. We use personal information to deter and minimize fraud and abuse and to help keep our Services safe;
  • To respond to inquiries. We may keep a record of your communication to help solve any issues you might be facing; and
  • To send email communications. We may use your email address to inform you about our Services, such as letting you know about upcoming changes or improvements or to market new features or offerings to you. You have the right to opt-out of receiving marketing communications from us at any time and this right is free of charge. Please see our section on communicating with you below.

When we share personal information

We do not share personal information with companies, organizations, and individuals outside of talech unless one of the following circumstances apply:

  • With your consent. We will share personal information with companies, organizations or individuals outside of talech when we have your consent to do so.
  • Administrators. If your talech account is managed for you by an administrator who provides support to your organization, that administrator will have access to your talech account information (including your email and other data). Your domain administrator may be able to:
    • view statistics regarding your account.
    • change your account password.
    • suspend or terminate your account access.
    • access or retain information stored as part of your account.
    • receive your account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request.
    • restrict your ability to delete or edit information or privacy settings.
  • Affiliates, vendors, and agents. We provide personal information to affiliates or other trusted businesses or persons to process it for us or to act on our behalf (“service providers”). These service providers are subject to contracts and confidentiality agreements and have no independent rights to use data outside of what this Privacy Policy allows. Occasionally we may use service providers who are located outside of Canada to process and/or store personal information for us. Please also see international transfers and data storage section below.
  • Legal process. We will share personal information when we respond to valid subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • Other. We will share personal information with companies, organizations or individuals outside of talech if we have a good-faith belief that we need to do so to:
    • enforce applicable Terms of Service, including investigation of potential violations.
    • detect, prevent, or otherwise address suspected fraud, security or technical issues.
    • protect against harm to the rights, property or safety of talech, our users or the public as required or permitted by law.

We may share aggregated, non-personally identifiable information and de-identified data publicly and with our partners. For example, we may publish data or reports to show trends about the general use of our Services that include aggregated and non-identifiable data.

We use analytics service providers to better understand usage patterns on the talech website. These providers collect information on our behalf using cookies and similar technologies. We use these service providers to better understand how people use our services so that we can improve the design and usability of our products. We do not engage in "tracking" users outside of our service and website. Consistent with this, we do not take any action when a browser sends us a DNT (do-not-track) signal.

If talech is involved in a merger, acquisition, or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

Cookies

talech uses cookies, web beacons, and similar technologies. These allow us to better understand the usage and traffic pattern of visitors and users on our site and to enable certain functionality on our Services. While you can manage your cookie settings in your computer or device’s browser, please be aware that certain parts of our website may not function properly if your browser is set not to allow cookies.

Access, Correction, and Retention

You can directly access, edit, and delete personal information and other content you’ve uploaded as part of your talech account. Some information is required in order to have an account like your name, address, and billing information.

If you need to request correction of information that talech has about you that is no longer accessible to you directly online, you may contact us to make your request. You can also submit a request to access or otherwise edit your personal information by contacting us. If you request a copy of the personal information we hold on file about you, it may be subject to an administrative fee.

Your rights to accessing your personal information are not absolute. We may deny you access when: (i) required or authorized by law; (ii) granting you access would have an unreasonable impact on other people’s privacy; and (iii) required to protect our confidential commercial information. If we deny your request to access or correct information, we will explain why.

If your talech account is closed, inactive, or suspended, talech may maintain certain information for record-keeping and analysis purposes. For example, we may keep your merchant account open so that you can access information for tax purposes. In any event, we will only keep your personal information for as long as necessary to complete our dealings with you, or as may be required by law, whichever is longer. While we retain information for these purposes we may, at our sole discretion, delete it for any reason at any time and are under no obligation to maintain it.

Termination of talech Account

When a Merchant terminates its account with talech, we return all Customer Data collected through the Merchant’s use of our Services to the Merchant. Once Customer Data is returned to the Merchant, it is the Merchant’s responsibility to ensure its collection, use and disclosure of your personal information in its custody complies with the applicable laws.

Security

talech takes reasonable measures to protect your personal information in an effort to prevent loss, misuse and unauthorized access, disclosure, alteration, and destruction. We take the following steps to help keep personal information secure:

  • We encrypt data transmissions using SSL technology.
  • We have reasonable measures in place to protect the physical security of records we store on our premises.
  • We restrict access to personal information to talech employees, contractors, and agents who need to know that information in order to process it for us for the purposes described above, and who are subject to confidentiality or employment agreements.

talech will never ask you for financial or sensitive information or for your account password in an email or phone call. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse.

Third Party Material

Our website and application may contain links to other third party sites and content (“third party materials”). These links are provided as a convenience for you only. Accessing third party materials is at your own risk. We accept no liability howsoever arising for the content, accuracy or reliability of any third party materials or websites, or any part of them, which may be referenced from time to time by link or other means at this site or for the data collection and use practices or security measures exercised by third parties.

International Transfers and Data Storage

Your personal information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction and may be subject to access by law enforcement authorities of those jurisdictions. If you are located outside the United States and choose to provide personal information to us, talech transfers that information to the United States and processes it there. Our Privacy Officer, whose contact information is provided below, can provide further information about our policies and practices regarding the use of service providers located outside Canada. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Changes

As our business is growing and changing, we expect that our Privacy Policy may change from time to time. We will post changes to this Privacy Policy on our site or notify you by email.

Communicating with You

Subject to providing your express consent evidenced by checking the box and opting in during when you register for a talech account, download our application, or submit an inquiry through our website, you consent to receiving promotional messages and newsletters from us. If you choose not to opt-in (e.g. by not checking the box or otherwise providing express consent), the remainder of the Terms of Use and this Privacy Policy will continue to apply to your use of our Services.
